User Agreement

aigctiny.com is an Internet software service provided by the AigcTiny team (hereinafter referred to as "we" or "us"). This Service Agreement (hereinafter referred to as "this Agreement") is an agreement between you (hereinafter referred to as "you" or "user") and us regarding your access to and use of the services provided by AigcTiny (hereinafter referred to as "AigcTiny Service" or "the Service").

Before creating an account for this service and using it, you must first agree to this Agreement. Before accepting this Agreement, please read it carefully. If you cannot understand or do not agree to any content of this Agreement, please do not visit or use any other services provided by us. Your actions such as clicking confirmation on the web page, actually purchasing, or using the service indicate that you have read and fully understood the content of this Agreement, have the civil right capacity and civil conduct capacity required to enter into this Agreement (or you meet the requirements of the "Youth Special Agreement" part of this Agreement), have reached an agreement with us on the use or ordering of corresponding products and/or services, and agree to accept all the terms of this Agreement and are bound by it.

We are committed to creating a variety of products and services to meet your needs. We will generate corresponding application accounts based on your registration information. Our products can obtain the information of the corresponding application account when providing services to you.

Special reminder to you to pay attention to the agreement content about restrictions, exemption of our liability, user's right restriction agreement, identification and handling of illegal/breaching behavior, and the choice of jurisdiction court, etc. The above agreements may be highlighted in bold and/or underlined to remind you to pay attention. You agree that we have the right to revise this Agreement from time to time. The revised Agreement will be notified to you by publishing it on the website and will replace the original service agreement. Your continued access to and use of AigcTiny is deemed as your acceptance of the revised service agreement. If you do not agree with all or part of the revised service agreement, you have the right to terminate the service agreement by stopping to visit AigcTiny or refusing to use the corresponding service, deleting your information on AigcTiny and account, etc., so that the revised content does not take effect on you.

If you register, log in, and use AigcTiny on behalf of an organization rather than yourself, you will be deemed to have the full authorization of the organization, and have the right to agree to this service agreement and the modifications and supplements to the service agreement on behalf of the organization.

1. Service Content

1.1 The " AigcTiny Service" in this Agreement refers to: the products and services displayed on the aigctiny.com website (i.e., AigcTiny official website), including but not limited to all services provided through web pages, mobile APPs, etc. The specific service content is subject to the content you use or order.

1.2 If you do not obtain the AigcTiny service from our official channel or a third party authorized by us, we cannot guarantee that the service can be used normally, and we do not assume any responsibility for the loss caused by this kind of acquisition method and use behavior.

1.3 According to actual needs and other service content we provide from time to time, we may sign other agreements with you ("Other Agreements"). At the same time, even if no other agreement is signed, your use of specific services of AigcTiny will also be deemed as your agreement to any requirements of us for those specific services. If there is a conflict between other agreements and this agreement, the other agreement shall prevail, but only to the extent of the conflict and related to the specific matters of that agreement.

1.4 We reserve the right to change, suspend, or terminate some free services at any time, and reserve the right to adjust the types and forms of free services provided by AigcTiny at any time according to the actual situation. We do not assume any responsibility for any loss caused by the adjustment of any free service provided by AigcTiny. We have the right to charge corresponding service fees for any free service content at an appropriate time in the future. We will notify you in advance of the above adjustments by means of station announcements, emails, or official website announcements, and give you a reasonable period to complete data download and backup. The free service of AigcTiny may be limited in the number of people, the number of projects, or functions. You can lift these restrictions by opening a paid version, and the specific information is subject to the description of the AigcTiny official website.

1.5 Before using the AigcTiny service, you should read and understand the description of the corresponding service on the AigcTiny official website, especially the restrictions on functions and service standards of free services and various paid services. We do not assume any legal responsibility for any loss caused by your failure to fully understand the above description and restrictions.

2. Account

2.1 To access and use AigcTiny, you must register a AigcTiny account. When registering an account, you need to provide true and accurate information. If your information changes, please update it in your account in time. You are responsible for (a) the confidentiality of your account, and (b) any passwords, identity verification keys, or security credentials used to activate your access to the service, and (b) all activities under your account, whether by you or your end users. If there is any unauthorized or abusive behavior or any security incident related to the service under your account, please notify us immediately. You acknowledge and agree that we are not responsible for any unauthorized or abusive behavior in your account, unless it is caused by our breach of this Agreement.

2.2 We and you should comply with relevant laws and regulations for real-name authentication. For the use of AigcTiny services, we may require you to provide further identity information, business qualifications, and information to complete identity authentication or qualification verification. Only after completing the corresponding identity authentication and qualification verification can you order and use related services. You understand and agree that we have the right to review the information you provide during real-name authentication on our own or through a third party to determine whether it is true, accurate, and valid, and we have the right to take measures such as not passing, blocking, or deleting for accounts that violate the agreement. You are aware and agree that if you do not complete real-name authentication in accordance with relevant laws and regulations and our requirements, it will affect your access to or use of this service.

2.3 You declare and guarantee that the information you provide to us is true, accurate, valid, and up-to-date, otherwise you should bear all legal responsibilities arising therefrom. Despite the above provisions, we have no obligation to assume any responsibility for any user's registration information, including but not limited to the responsibility to identify, verify the authenticity, accuracy, completeness, applicability, and/or whether it is the latest information of any registration information.

2.4 We suggest that you keep your registration email, phone number, password, and name properly, and accurately enter this information as a key part of you accessing and logging in to AigcTiny and enjoying the service. If you find that someone is using your account information without authorization or suspect that anyone may be able to access your private content without authorization, you should immediately change your password and feedback to us.

2.5 If you are an enterprise/organization user, you can create your enterprise or organization after logging into this software. You can choose to invite enterprise/organization members to join this software to become your end users through phone numbers, emails, invitation links, etc. (the specific method is subject to the method actually provided by AigcTiny).

2.6 If you accept an invitation to become an end user of an enterprise/organization, you can enjoy the services provided to the enterprise/organization user by us, and the service content is subject to the functions we actually provide and the service opening situation of the enterprise/organization user. The enterprise/organization you are in and its administrators manage the enterprise/organization member identity and related rights based on the enterprise/organization management needs, including but not limited to adding, deleting, adjusting permissions, and restricting service content. You promise to use this service in accordance with this service specification, and in accordance with the authorization scope and specifications of the enterprise/organization.

2.7 As an enterprise/organization user, when uploading and managing the names, phone numbers, and other personal information of end users, please ensure that you have obtained the explicit consent of the end users in advance, only collect user information that is necessary for operation and function realization, and have fully informed the end users of the purpose, scope, and use of the data collection, and remind the end users that they can further understand the rules for the collection and processing of personal information in the product privacy policy and the rights they have regarding personal information.

3. Use

3.1 You declare and guarantee that the content you upload or store on AigcTiny does not violate this agreement and complies with laws and regulations. You are responsible for the legality, accuracy, completeness, and reliability of the content you upload or store. You are responsible for obtaining and maintaining any notices, consents, or authorizations related to your content. Unless otherwise stipulated by law, we do not assume any obligations and responsibilities related to the content you upload or store. If you upload or store content that infringes on the intellectual property rights of others or violates laws and regulations on AigcTiny, we have the right to delete it and reserve the right to transfer it to the judicial authorities for processing.

3.2 You may not use AigcTiny to upload, store, share, send, or disseminate any sensitive information and information that violates national laws and regulations, including but not limited to the following information:

- Opposing the basic principles determined by the Constitution;

- Endangering national security, leaking state secrets, subverting state power, and undermining national unity;

- Damaging national honor and interests;

- Instigating ethnic hatred, ethnic discrimination, and undermining national unity;

- Undermining national religious policies, promoting cults, and feudal superstitions;

- Spreading rumors, disturbing social order, and undermining social stability;

- Spreading obscenity, pornography, gambling, violence, murder, terrorism, or instigating crime;

- Insulting or defaming others and infringing on the legal rights and interests of others;

- Containing other contents prohibited by laws and administrative regulations.

You promise to make speeches: patriotic, law-abiding, self-disciplined, truthful, and civilized. Do not spread any illegal, harassing, insulting, abusive, threatening, harmful, vulgar, endangering national security, leaking state secrets, undermining national religious policies, and ethnic unity, and other contents that violate laws and regulations. If your behavior does not conform to the service agreement mentioned above, AigcTiny will make an independent judgment and immediately suspend or terminate your service account. You need to bear all legal responsibilities for your actions, and AigcTiny does not bear any legal responsibility.

3.3 You may not post, transmit, disseminate, or store content that infringes on the legal rights of others, such as reputation, portrait, intellectual property rights, trade secrets, etc.

3.4 You may not create, copy, publish, or disseminate information involving others' privacy, personal information, or data.

3.5 You shall not post, send, disseminate, or store harassment, advertising information, excessive marketing information, spam, or content containing any sexual or sexual implications.

3.6 You shall be responsible for all your actions and activities under your account when using AigcTiny (whether by you or your authorized persons). You may not use AigcTiny to engage in activities that violate laws and regulations, violate the agreement of this user, endanger network security, endanger computer system security, damage the integrity of AigcTiny products, or infringe on the interests of AigcTiny and any third party. If you engage in the above behaviors, we have the right to suspend or terminate your account and refuse you to use all or part of the functions of AigcTiny now and in the future. All losses caused to us or third parties and all legal responsibilities arising therefrom shall be borne by you.

4. Content and Intellectual Property

4.1 The ownership of the content you upload on AigcTiny belongs to you. You understand that we are not responsible for any content you provide, and we are not obligated to review such content in advance. However, AigcTiny has the right to decide at any time whether any content you provide complies with relevant laws and regulations or the relevant provisions of this agreement, and can review, transfer, reject, modify, and/or delete the content you upload at any time without prior notice to you. If your behavior in using this service exists or is suspected of violating national laws and regulations or infringing on the legal rights and interests of any third party, we have the right to directly delete the information that violates the regulations and can suspend or terminate your service.

4.2 The ownership and all intellectual property rights related to the AigcTiny service (including but not limited to source code, target code, documentation, interface design, page framework, and any software, information, etc. provided by us for maintenance and technical support) belong to us. You acknowledge our ownership and intellectual property rights and promise to respect and not infringe on our ownership and intellectual property rights to AigcTiny in any way. Without our written permission, you cannot copy, clone, transfer, license, or provide others to use the above knowledge results, or privately use any part of the code and design appearance, otherwise you should bear the corresponding legal responsibility, and we have the right to terminate the service and not refund any fees.

4.3 For enterprise users, we may use the name, trade name, trademark, and other information or logos of enterprise users on our website, our activities, or other promotional promotions to promote this service.

5. Privacy Policy

5.1 Before using AigcTiny, by reading and clicking to agree to the "AigcTiny Privacy Policy" and actually using this service, it indicates that you authorize us to legally collect and use technical or diagnostic information about you and the service you use. Based on the need to provide services, mobile users only call up recording, taking photos, reading albums, and other permissions when used for feedback suggestions and problems. The collected information will be used to improve the content and technology of AigcTiny services and improve our service quality. We will not share or sell your information and content to third parties. However, the following situations are excluded:

- Based on specific service purposes and with your explicit authorization in advance;

- Comply with applicable laws and regulations;

- Comply with court orders or other legal procedures;

- Comply with the requirements of relevant government departments;

- Directly related to national security, defense security, public security, public health, public interest;

- Collecting personal information from legally disclosed information, such as legal news reports, government information disclosure, and other channels;

- We believe it is reasonably necessary to comply with applicable laws and regulations, maintain social public interests, or protect our customers, other users, or employees' personal and property safety or legal rights and interests;

- You violate this service agreement, and we need to provide it to third parties for rights protection;

- Other situations stipulated by laws and regulations.

5.2 Protecting user personal information is one of our basic principles. We will collect, use, store, and share your personal information according to the agreement of the "AigcTiny Privacy Policy", and how you manage your personal information, how we take necessary measures to ensure the security of your personal information, and how we respond to your rights requests. You declare and guarantee that you have carefully read, fully understood, and agreed to all the contents of the above "AigcTiny Privacy Policy". If you do not agree with this agreement and the "AigcTiny Privacy Policy", please immediately stop using any services or products provided by us.

6. Data and Information Security

6.1 We share the responsibility of maintaining account security with you. We strive to protect the security of your account on the server side under the current technical level and continuously update technical measures. However, the Internet is not an absolutely safe environment. We especially remind you to properly keep your account and password, and eliminate harmful behaviors such as privately lending or even selling accounts to others. In addition, we suggest that you set your account password with a combination of complex characters. Please understand that we are not responsible for any loss caused by your behavior that violates relevant laws and regulations and the agreement of this account and leads to unauthorized access to data, leakage, damage, or destruction.

6.2 We will take reasonable technical measures and other necessary measures to protect your data and information security in accordance with the provisions of laws, administrative regulations, and mandatory requirements of national standards. However, due to the special nature of Internet services (including but not limited to the stability issues of cloud servers, communication infrastructure failures, network hacker attacks, government regulations, and other uncontrollable situations), the services we provide may be interrupted, delayed, restricted, abnormal, unable to be used, temporarily closed, etc., and we are not responsible for any legal responsibility. We will notify you as soon as possible through website announcements, system notifications, SMS, or other reasonable methods.

6.3 You are aware and agree that AigcTiny service is a SAAS service provided based on third-party cloud services. Due to the special nature of network services (including but not limited to cloud server stability issues, communication infrastructure failures, network hacker attacks, government regulations, and other uncontrollable situations), the services we provide may be interrupted, delayed, or unable to meet your requirements. Please be aware and understand that this situation will not be considered as a violation of this agreement by us, but we will notify you as soon as possible through website announcements, system notifications, SMS, or other reasonable methods. You can delete or change the data you upload and store on AigcTiny at any time. Please be cautious when operating the deletion or modification of data. When the service is terminated in advance (including account cancellation or other reasons for early termination, etc.), except as stipulated by laws and regulations, requirements of competent departments, or other agreements between the two parties, AigcTiny will continue to store your business data for a certain buffer period (subject to the time limit stated in the exclusive agreement, product documentation, service description, etc. applicable to the service you ordered), and all user business data will be deleted after the buffer period expires, including all cached or backed-up copies, and we will not retain any of your data. Once the user business data is deleted, it cannot be recovered; you shall bear the consequences and responsibilities arising from the deletion of the data, and you understand and agree that after the service is terminated and the buffer period agreed with you expires, we are not obligated to continue to retain, export, or return user business data.

7. Disclaimer You are aware and agree

Under the following circumstances, we do not need to bear any responsibility:

7.1 Due to your improper maintenance or confidentiality, resulting in the loss or leakage of data, materials, passwords, etc., or other personal information leakage not caused by us, we do not bear any legal responsibility;

7.2 Any suspension, interruption, delay, restriction, abnormal use, inability to use, temporary website closure, etc., of AigcTiny caused by force majeure, hacker attacks, computer virus invasion, reasons of network operators, or government regulations, or other reasons that we cannot reasonably control, we do not bear any legal responsibility;

7.3 You are responsible for the legality of the files, data, and content uploaded or stored through AigcTiny, and the legality of obtaining the files, data, and content. Any disputes arising therefrom shall be borne by you, and we do not bear any legal responsibility;

7.4 The Internet is an open platform. If you upload and disseminate pictures, text, and other content, it may be copied, reprinted, altered, or used for other illegal purposes by other organizations or individuals. You should be fully aware of the existence of such risks. You agree that the risks and consequences of using our services will be borne by you, and we do not bear any responsibility.

7.5 You understand and confirm that due to technical limitations, we cannot guarantee that the services we provide are flawless, but we promise to continuously improve the service quality and level to provide you with better services. Therefore, you agree that if there are flaws in the services we provide, and these flaws are unavoidable at the current industry technical level, they will not be considered a breach of contract, and we do not need to bear any responsibility.

7.6 Our services are provided through facilities within the mainland of the People's Republic of China. We cannot ensure that your use of the behavior, the information and content published are appropriate and feasible in other countries or regions. When you use this software and related services in other jurisdictions, you should ensure that they comply with local laws and regulations, and we do not bear any responsibility for this.

7.7 If we find out, or through third-party reports or complaints, that the content you post exists or is suspected of violating national laws and regulations or the rules of this software, we have the right to take all necessary measures (including but not limited to immediately deleting the content you post, freezing account numbers, reporting to public security organs, etc.) or cooperate with the law enforcement requirements of national net letter departments, public security organs, procuratorial organs, etc. to deal with accounts accordingly to reduce or eliminate the impact of your behavior.

8. Service Change/Interruption/Termination

8.1 You can cancel your account and stop using AigcTiny services at any time. The method of account cancellation can follow the guidelines of the AigcTiny official website. You declare and guarantee that before you independently cancel your account, you have downloaded and backed up all the data you uploaded and stored on AigcTiny. After you independently cancel your account and pass the buffer period, AigcTiny will no longer have any legal or agreed obligation to retain your data.

8.2 You understand and agree that if the AigcTiny service needs to be suspended, interrupted, delayed, restricted, abnormally used, unable to be used, temporarily closed, etc., due to system maintenance or upgrade needs, we will try to notify in advance on the website as much as possible to facilitate your early commercial arrangements and strive to minimize the actual impact on you, but we do not bear any legal responsibility.

8.3 When any of the following situations occur, we may terminate or suspend your use of all or part of the account and/or service:

- The information you provide is not true, or violates other user personal information provision rules;

- You violate laws and regulations, this agreement, or other agreements with us;

- You request to cancel or terminate your account;

- Use AigcTiny products for commercial purposes or other profitable purposes without our consent;

- Your access to or use of AigcTiny may pose a security risk to AigcTiny services, us, or third parties;

- Need to comply with court subpoenas, legal orders, or follow legal procedures;

- According to the requirements of relevant laws and regulations or government agencies;

- Due to force majeure such as natural disasters, war, etc.;

- This agreement is changed or modified, and you do not agree with the changed or modified user agreement.

8.4 You understand and recognize that for technical upgrades, service system upgrades, or due to changes in business strategy or to cooperate with major national technology, laws, and policies, we do not guarantee to provide a certain service permanently, or we may change the form, specifications, or other aspects of the service provided. Before terminating the service or making such changes, we will make every effort to notify in advance through website announcements, station letters, emails, SMS, or other one or more methods; if the service is terminated, we will make every reasonable effort to give you a reasonable amount of time to properly handle subsequent matters.

8.5 Once your account is terminated, you will not be able to use the service normally. In addition, you can choose to delete all the information and content under your account before the account is terminated.

9. Improvement and Modification of This Service Agreement

9.1 We have the right to improve and modify this agreement from time to time according to the development of the Internet and the changes in laws and regulations in the People's Republic of China. We reserve the right to modify this agreement at any time and will publish the modified service agreement on the AigcTiny official website. You are obliged to check the updates on the official website in a timely manner. The above publication is deemed to be a valid notice to you. When using our services, it is necessary to carefully read and reconfirm the latest "AigcTiny Service Agreement". When a dispute arises, the latest service agreement shall prevail.

9.2 If you do not agree with the modifications we make to this agreement, you should immediately stop using AigcTiny services. If the user continues to use AigcTiny services, it is deemed that the user accepts our modifications to this agreement.

10. Youth Special Agreement

10.1 The AigcTiny service is mainly for adults. If you are a minor, please ensure that your guardian has carefully read, understood, and accepted this agreement. Use AigcTiny services or provide us with information with the consent of your guardian.

10.2 If your guardian disagrees with you using AigcTiny services or providing us with information according to this agreement, please immediately stop using our services and notify us in time so that we can take corresponding measures.

10.3 You declare and guarantee that you are a natural person with full civil conduct capacity. If you purchase and use the paid services of AigcTiny against the above guarantee, we do not bear any legal responsibility, including but not limited to returning the price, and the losses caused shall be borne by you or your guardian.

11. Legal Application and Dispute Resolution

11.1 The establishment, effectiveness, interpretation, revision, supplement, termination, execution, and dispute resolution of this agreement are all governed by the laws of mainland China; in the absence of relevant legal provisions, refer to commercial practices or industry practices.

11.2 All disputes arising from your use of AigcTiny services and related to this agreement shall be resolved through negotiation between us and you. If the negotiation fails, either party may file a lawsuit in the people's court of our domicile.

11.3 If the user uses the service to engage in any illegal or infringing activities, the user shall bear all responsibilities, and we do not bear any legal responsibility. If it causes any loss to us or any third party, the user shall be responsible for full compensation.

13. Other Agreements

13.1 When all or part of the rights and obligations of this agreement are transferred to our affiliated companies, we will make every reasonable commercial effort (including but not limited to email, SMS, or official website announcements) to contact you and negotiate with you on related matters. At the same time, we promise not to substantially reduce the quality of services you can obtain.

13.2 Without our prior consent, you may not assign any rights or obligations under this agreement to third parties.

13.3 If any part of this agreement is declared invalid or unenforceable for any reason, it does not affect the validity of the other agreements, and the other agreements shall continue to apply. Any invalid or unenforceable agreement shall be replaced by another agreement that is consistent with the purpose and intent of this agreement.

13.4 We are not responsible for any failure to perform all agreements and terms due to circumstances beyond our reasonable control.

13.5 We may send notices to you through station messages or telephone, email, or other contact information you provide when registering an account, using AigcTiny services, etc. The above notices are deemed effective upon issuance to you, and you are obliged to ensure the validity of your contact information.

13.6 Unless we confirm and agree in writing, our failure to perform any rights or agreements in this agreement does not constitute a waiver of the relevant rights or agreements.

13.7 Last revised on May 10, 2022. We reserve all rights.
